Terms of Use

1. Agreement to Terms

By accessing, browsing, or using any part of Find Texas Plumbers (the "Platform"), you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to comply fully with these Terms, our Privacy Policy, and all applicable laws and regulations.

These Terms apply to all users of the Platform including homeowners, visitors, business owners, and listing subscribers. Your continued use of the Platform following any modification constitutes your acceptance of the revised Terms.

If you are using the Platform on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Eligibility and Permitted Use

You may use Find Texas Plumbers only if you meet all of the following eligibility criteria:

• You are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater.
• You are not prohibited from using the Platform under the laws of the United States, the State of Texas, or any other applicable jurisdiction.
• You have not been previously suspended or removed from the Platform.
• You are using the Platform for lawful purposes only and not in connection with any fraudulent, deceptive, or harmful activity.

3. Account Registration and Security

Certain features of Find Texas Plumbers require you to create a user account. By registering, you agree to:

• Accurate Information: Provide truthful, accurate, current, and complete information during registration and keep your account information updated.
• Account Security: Maintain the confidentiality of your account credentials and not share your login credentials with any third party.
• Account Activity: Accept full responsibility for all activities, submissions, and transactions that occur under your account.
• Notification of Breach: Notify us immediately via our contact page if you become aware of any unauthorized use of your account or any security breach.
• One Account Per Business: Each business entity is permitted to maintain only one active listing account. Duplicate accounts are prohibited.

We reserve the right to refuse registration, cancel accounts, or remove content at our sole discretion, particularly where submitted information is false, fraudulent, or in violation of these Terms.

4. Business Listings and User-Submitted Content

Find Texas Plumbers allows licensed Plumbers businesses to submit and manage a public-facing listing. By submitting a listing or any content, you represent, warrant, and agree that:

• All information in your listing — including business name, address, phone number, license numbers, service descriptions, and photographs — is accurate, current, and not misleading.
• You have full legal right and authority to submit the content, and doing so does not infringe upon the rights of any third party.
• Your business holds all applicable licenses, permits, and certifications required by the State of Texas and any applicable local municipality.
• You grant Find Texas Plumbers a non-exclusive, royalty-free, worldwide license to use, reproduce, display, distribute, and promote your submitted content for operating and marketing the Platform.
• You understand that your listing may be publicly indexed by search engines, making your business information accessible to the general public.

We reserve the right to review, edit, refuse, or remove any listing or content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. Removal of content does not entitle you to a refund of any subscription fees paid.

5. Subscription Fees, Billing, and Refund Policy

Find Texas Plumbers offers both free and premium paid listing tiers. By selecting a premium plan, you agree to the following:

• Annual Subscription: Premium listings are billed annually and will automatically renew at the then-current standard rate unless cancelled prior to renewal.
• Founding Member Pricing: Where founding member pricing has been accepted, the discounted rate remains locked for the duration of your continuous subscription provided your account remains active and in good standing.
• Payment Processing: All payments are processed securely through our designated payment processors. By submitting payment information, you authorize us to charge the applicable fees to your selected payment method.
• No Refunds: All subscription fees are non-refundable once a listing has been activated, except where required by applicable law.
• Failed Payments: In the event of a failed payment, we reserve the right to downgrade your listing to the free tier until payment is successfully processed.
• Price Changes: We reserve the right to modify subscription pricing with no less than thirty (30) days' notice prior to the next billing cycle.

Any billing disputes must be submitted via our contact page within sixty (60) days of the charge in question. Failure to dispute within this timeframe constitutes a waiver of your right to contest the charge.

6. Listing Quality Standards and Content Guidelines

All business listings must adhere to the following quality and content standards:

• Listings must represent a real, operating business actively providing Plumbers services within Texas.
• Business descriptions must be accurate and must not include keyword stuffing, promotional spam, or content designed to manipulate search rankings artificially.
• Photographs uploaded to listings must be genuine representations of your business, work, or team. Stock photographs presented as original work are prohibited.
• Customer reviews must be authentic and reflect genuine customer experiences. Review manipulation is strictly prohibited and may result in immediate listing removal.
• Contact information must be accurate and functional at all times.
• Any claim of licensure, certification, insurance, or professional affiliation must be verifiable and currently valid.

7. Prohibited Activities

You expressly agree that you will not engage in any of the following prohibited activities:

• Submitting false, fabricated, or misleading business information, including fictitious license numbers or fabricated customer reviews.
• Impersonating any person, business, or entity, or falsely claiming an affiliation with any third party.
• Uploading content that is defamatory, obscene, harassing, threatening, discriminatory, or otherwise unlawful.
• Using automated software, bots, spiders, crawlers, or scrapers to access or extract data from the Platform without our prior written consent.
• Attempting to gain unauthorized access to any portion of the Platform, user accounts, or our server infrastructure.
• Using the Platform to send unsolicited commercial communications or harvesting contact information from listings for spam purposes.
• Engaging in any activity that imposes an unreasonable load on the Platform's infrastructure or degrades the experience for other users.
• Reproducing, selling, reselling, or exploiting any portion of the Platform or its content for commercial purposes without our prior written authorization.
• Using the Platform in any manner that violates any applicable federal, state, local, or international law or regulation.

Violations may result in immediate account suspension, permanent removal from the Platform, and where applicable, referral to appropriate law enforcement authorities.

8. Intellectual Property Rights

All content, design elements, software, source code, graphics, logos, trademarks, and other materials comprising the Platform — excluding user-submitted listing content — are the exclusive intellectual property of Find Texas Plumbers and its licensors, protected by applicable copyright and trademark laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for its intended purposes. This license does not include the right to reproduce, distribute, or create derivative works from Platform content without our express written permission.

If you believe that any content on the Platform infringes your intellectual property rights, please notify us via our contact page.

9. Third-Party Services, Links, and Integrations

Find Texas Plumbers may contain links to third-party websites, platforms, or resources. These links are provided solely for your convenience and informational purposes. We do not control, endorse, or assume any responsibility for the content, privacy practices, or reliability of any third-party websites.

Any transaction or engagement between a homeowner and a listed business — including hiring a Plumbers, agreeing on service terms, or making payment for services — is a private transaction conducted solely between those parties. Find Texas Plumbers is not a party to such transactions and assumes no liability for the quality, safety, legality, or outcome of any services performed by listed businesses.

10. Disclaimer of Warranties

Find Texas Plumbers is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind. To the fullest extent permissible under applicable law, we expressly disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the Platform will be uninterrupted, error-free, or free of harmful components.
• Any warranty that business listings are accurate, complete, or that listed businesses are properly licensed, insured, or bonded.
• Any warranty that defects in the Platform will be corrected within any particular timeframe.

Your use of the Platform and reliance on any listing information is entirely at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Find Texas Plumbers, its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including loss of profits, data loss, business interruption, or damages arising from transactions between homeowners and listed businesses.

In no event shall our total aggregate liability exceed the greater of: (a) the total subscription fees paid by you to Find Texas Plumbers in the twelve (12) months immediately preceding the claim; or (b) one hundred United States dollars ($100.00 USD).

12. Indemnification

You agree to defend, indemnify, and hold harmless Find Texas Plumbers, its affiliates, directors, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of or access to the Platform.
• Your violation of any provision of these Terms.
• Your violation of any third-party rights, including intellectual property or privacy rights.
• Any inaccurate or misleading information contained in your business listing.
• Your violation of any applicable law, regulation, or rule.

13. Account Suspension and Termination

We reserve the right to suspend, restrict, or permanently terminate your access to the Platform at any time, with or without notice, in circumstances including but not limited to:

• Any violation of these Terms or our published policies.
• Submission of false, misleading, or fraudulent listing information.
• Non-payment of applicable subscription fees.
• Conduct determined to be harmful to other users, third parties, or the Platform.
• A request or order from a law enforcement agency or government authority.

If you wish to voluntarily terminate your account, please contact us via our contact page. Voluntary account termination does not entitle you to a refund of any prepaid subscription fees.

14. Dispute Resolution and Arbitration

In the event of any dispute arising out of or relating to these Terms or your use of the Platform, you agree to first attempt informal resolution by contacting us via our contact page with a written description of the dispute. We will make reasonable efforts to address your concern within thirty (30) calendar days.

If the dispute cannot be resolved informally, you agree that it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in the State of Texas.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions. You consent to the exclusive personal jurisdiction and venue of the state and federal courts located in the State of Texas for any legal proceedings not subject to arbitration.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Modifications to These Terms

Find Texas Plumbers reserves the right to amend or replace these Terms at any time. When we make material changes, we will update the "Last Updated" date and, where appropriate, provide additional notice to registered users. Your continued use of the Platform after any modification constitutes your acceptance of the revised Terms.
